Prosecutors in the UK have discontinued two indecent assault charges against the disgraced Hollywood film producer Harvey Weinstein. The Crown Prosecution Service (CPS) said it had made the decision after reviewing the evidence in the case and concluding "there is no longer a realistic prospect of conviction".
Weinstein, 72, was charged in 2022 with two counts of indecent assault against a woman in London for alleged offences in 1996. The alleged victim is a woman who is now in her 50s, the Metropolitan Police said at the time.
Frank Ferguson, head of the special crime and counter-terrorism division at the CPS, said it had a duty to continuously review criminal cases and had "explained our decision to all parties".
“We would always encourage any potential victims of sexual assault to come forward and report to police and we will prosecute wherever our legal test is met.”
The decision comes as Weinstein faces a new trial in New York after his 2020 rape conviction was overturned in April. He is still being held in New York City's Rikers Island jail while he awaits a retrial later this year.
Weinstein was also sentenced to 16 years in prison in a separate rape trial in California, which he is appealing against.
More than 100 people have made rape and misconduct allegations about Weinstein dating back to the late 1970s. The decision by his accusers to come forward, and his subsequent conviction in New York, galvanised the #MeToo movement against sexual abuse by powerful men. Weinstein has always maintained his innocence and argued he was the victim of a “set-up”.
He co-founded the Miramax film studio, which produced hits including Shakespeare in Love - which won best picture at the Academy Awards - and Pulp Fiction. His films have received more than 300 Oscar nominations and 81 statuettes. In 2020 he was stripped of his honorary CBE, which had been awarded for his contribution to the British film industry.
Weinstein's Legal Battles Continue
Despite the dropped charges in the UK, Weinstein's legal battles are far from over. He is facing a retrial in New York in November, and is appealing his conviction in California. The decision to drop the charges in the UK is likely to be seen as a setback for those hoping to see Weinstein held accountable for his alleged crimes.
New York Retrial Looms
The New York Court of Appeals overturned Weinstein’s 2020 conviction because the judge in the trial allowed testimony from women who were not part of the case. Prosecutors in New York are now seeking to combine any new charges with the original charges so that they can be tried together.
California Conviction Appeal
Weinstein is also appealing his conviction in California, where he was sentenced to 16 years in prison for rape in 2023. His lawyers are arguing that the New York decision should bolster their efforts to appeal against his rape conviction in Los Angeles.
A New Chapter in the #MeToo Movement?
The decision to drop the charges against Weinstein in the UK is likely to be seen as a setback for the #MeToo movement. However, the movement continues to have a profound impact on the way sexual harassment and assault are addressed. It has led to a greater awareness of these issues, and has empowered victims to come forward and seek justice.
The case of Harvey Weinstein is a reminder that the fight for justice is often a long and arduous one. But it is also a testament to the power of the #MeToo movement to hold perpetrators accountable and to create a safer world for all.
A Long Road to Justice
The #MeToo movement has brought about significant changes in the way sexual harassment and assault are handled. However, the case of Harvey Weinstein is a reminder that there is still much work to be done. The fight for justice for victims of sexual assault is an ongoing one.
What's Next for Weinstein?
Weinstein remains in custody in New York while he awaits his retrial. His fate is still uncertain, but the decisions made by the courts in the UK and New York will have a significant impact on his future. The #MeToo movement has shown the world that sexual harassment and assault are not acceptable, and that those who commit these crimes will be held accountable. The fight for justice is ongoing, but the #MeToo movement has made significant progress in creating a safer and more equitable world for all.
